Terms of Service Agreement

This Terms of Service Agreement (the "Agreement") is entered into between Chat Rewards ("Bot Owner") and the user ("User") of the Chat Rewards Discord bot (the "Bot") and/or the website located at https://chatrewards.xyz (the "Website").

By accessing or using the Bot or Website, the User agrees to be bound by the terms of this Agreement. If the User does not agree to these terms, they should immediately discontinue use of both the Bot and the Website.

1. Use of the Bot and Website

The Bot Owner grants the User a non-exclusive, non-transferable, limited license to use the Bot and access the Website for personal or non-commercial purposes, in accordance with this Agreement.

2. Prohibited Use

The User agrees not to use the Bot or Website in any way that violates applicable laws, infringes upon the rights of any third party, or is otherwise prohibited by this Agreement. Additionally, the following actions are strictly prohibited:

• Do not take any actions to attempt to abuse, purposely disrupt, or cause damage to the service.
• Do not use the service in a manner inconsistent with any applicable laws or regulations of your local region.
• Do not attempt to access any data that you are not permitted to.
• Do not interfere with, disrupt, or create an undue burden on the service or the networks or services connected to the service.
• Do not attempt to bypass any measures of the service designed to prevent or restrict access to the service or any portion of the service.
• Do not use the service in any way that would violate the Discord Terms of Service or Discord Community Guidelines.

Commercial use of the Bot or Website is also strictly prohibited without the express written consent of the Bot Owner.

3. Limitation of Liability

The Bot Owner shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the Bot or Website, including but not limited to damages for loss of profits, data, or other intangible losses, even if the Bot Owner has been advised of the possibility of such damages.

4. Modifications to the Bot and Website

The Bot Owner reserves the right to modify, suspend, or discontinue the Bot or Website, in whole or in part, at any time and without prior notice. The User agrees that the Bot Owner shall not be liable to the User or any third party for any modification, suspension, or discontinuance of the Bot or Website.

5. Intellectual Property

All intellectual property rights in the Bot, Website, and related content are owned by the Bot Owner or its licensors. The User agrees not to copy, modify, reproduce, or distribute the Bot, Website, or any portion thereof without the express written consent of the Bot Owner.

6. Indemnification

The User agrees to indemnify, defend, and hold harmless the Bot Owner, its affiliates, and their respective directors, officers, employees, and agents from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to the User's use of the Bot or Website or violation of this Agreement.

7. Termination

This Agreement may be terminated by either party at any time, with or without cause. Upon termination, the User must immediately cease all use of the Bot and Website, and the Bot Owner reserves the right to restrict access to both without further notice.

8. Governing Law

This Agreement shall be governed by and construed in accordance with applicable international laws, without regard to conflict of law principles. Any dispute arising under or in connection with this Agreement shall be resolved through binding arbitration administered by a neutral arbitration provider chosen by the Bot Owner. The arbitration shall take place online or in a mutually agreed location, and both parties agree to submit to the jurisdiction of the arbitration provider.

9. Privacy Policy

By using the Bot and Website, the User agrees to the collection, storage, and processing of their information as outlined in the Privacy Policy provided on the Website. The User should review the Privacy Policy to understand their rights and responsibilities regarding their personal information.

10. Entire Agreement

This Agreement, along with the Privacy Policy, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral, relating to the Bot and Website.

By using the Bot and Website, the User acknowledges that they have read this Agreement, understand it, and agree to be bound by its terms and conditions.
